1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and AtelierMuseAI ("Company", "we", "us", or "our") governing your access to and use of the AtelierMuseAI website, AI video generation platform, and all related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Service Description

AtelierMuseAI is an AI-powered platform that enables users to create personalized short videos from text prompts using artificial intelligence technology.

3. Eligibility and Age Requirements

3.1. You must be at least 13 years of age to use our Services.

3.2. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use our Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.3. By using our Services, you represent and warrant that you meet the above eligibility requirements.

4. User Accounts

4.1. Registration: To access certain features, you must create an account by providing accurate, current, and complete information.

4.2. Account Security: You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately at support@ateliermuseai.com if you suspect any unauthorized access

4.3. Account Restrictions: You may not:

• Create multiple accounts for the purpose of abusing promotions or circumventing restrictions
• Share, sell, or transfer your account to any third party
• Use another person's account without their explicit permission

5. Subscriptions, Payments, and Billing

5.1. Subscription Plans: We offer various subscription tiers with different features, usage limits, and pricing. Details are available on our pricing page.

5.2. Billing Cycle: Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected).

5.3. Cancellation:

• You may cancel your subscription at any time through your account settings or by contacting support@ateliermuseai.com
• Cancellation takes effect at the end of your current billing period
• You will retain access to paid features until the end of your billing period

5.4. No Refunds: All purchases are final and non-refundable. This includes:

• Subscription fees (whether monthly or annual)
• Credit package purchases
• Any other paid features or services

As a digital service delivered immediately upon purchase, refunds are not provided once:

• You have accessed any premium features, OR
• Any credits have been used or added to your account

5.5. Price Changes: We reserve the right to modify pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle, with at least 7 days' prior notice.

6. Credits System

6.1. Subscription Credits:

• Credits included in subscription plans are allocated at the beginning of each billing cycle
• These credits are valid only for the current billing month and expire at the end of the billing cycle
• Unused subscription credits do not roll over to the next billing period

6.2. Credit Packages:

• Credits purchased as standalone packages are permanent and do not expire
• Package credits remain valid as long as your account is active and in good standing
• If your account is terminated for violation of these Terms, all credits (including package credits) will be forfeited without compensation

6.3. Credit Usage:

• Credits are deducted upon successful video generation
• Failed generations due to system errors will not consume credits
• There are no daily generation limits; usage is limited only by available credits

6.4. Credit Deduction: Credits are non-transferable and cannot be exchanged for cash or refunded under any circumstances.

7. Video Storage and Data Retention

7.1. Storage Periods:

• Free Users: Generated videos are stored for 3 calendar days from the date of creation
• Paid Subscribers: Generated videos are stored for 30 calendar days from the date of creation

7.2. Automatic Deletion: Videos are automatically and permanently deleted upon expiration of the storage period. This deletion is irreversible.

7.3. User Responsibility: You are solely responsible for downloading and backing up your videos before the storage period expires. We strongly recommend downloading videos immediately after generation.

7.4. No Liability for Data Loss: We expressly disclaim any liability for videos or content lost due to:

• Expiration of the storage period
• Account termination or suspension
• Technical issues or service interruptions

8. Content Ownership and Licensing

8.1. Your Input Content: You retain full ownership of the text prompts, ideas, and creative concepts you submit to generate videos.

8.2. Generated Content Rights:

• Free Users: You are granted a limited, non-exclusive, non-transferable license to use generated videos for personal, non-commercial purposes only
• Paid Subscribers: You are granted a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, publicly display, and commercially exploit generated videos

8.3. Restrictions on Generated Content:

• You may not claim that AI-generated content was created entirely by human effort when such disclosure is legally required
• You may not use generated content in ways that violate these Terms or applicable laws
• Commercial use by Free Users constitutes a material breach of these Terms

8.4. Platform Rights: By using our Services, you grant AtelierMuseAI a non-exclusive, royalty-free license to:

• Process your input content to provide the Services
• Use anonymized, aggregated usage data to improve our Services
• We will not use your specific content for marketing without your explicit consent

8.5. AI Technology Ownership: All AI models, algorithms, software, and underlying technology used to provide the Services remain the exclusive property of AtelierMuseAI and its licensors.

9. Prohibited Content and Conduct

9.1. Strictly Prohibited Content: You are absolutely prohibited from using our Services to create, generate, or distribute:

• Sexual Content: Pornography, sexually explicit material, or any content depicting sexual acts
• Violence: Content depicting graphic violence, gore, torture, or the glorification of violent acts
• Child Safety: Any content that depicts, exploits, or endangers minors, including but not limited to child sexual abuse material (CSAM)
• Hate and Discrimination: Content promoting hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Harassment: Content intended to harass, bully, threaten, or intimidate any individual
• Deception and Fraud: Deepfakes, synthetic media, or any content intended to deceive, defraud, or mislead others, including impersonation for fraudulent purposes
• Political Manipulation: Disinformation, election interference content, or political propaganda designed to mislead
• Illegal Content: Any content that violates applicable laws, including but not limited to content promoting illegal activities, terrorism, or drug trafficking
• Intellectual Property Infringement: Content that infringes upon copyrights, trademarks, or other intellectual property rights of third parties

9.2. Prohibited Conduct: You agree not to:

• Attempt to reverse engineer, decompile, or extract source code from our AI systems
• Use automated scripts, bots, or tools to access or abuse our Services
• Circumvent any usage limits, security measures, or access controls
• Interfere with or disrupt the integrity or performance of our Services
• Access or attempt to access accounts or data belonging to other users

9.3. Enforcement:

• We actively monitor for policy violations using automated systems and manual review
• Violations may result in immediate account suspension or permanent termination without prior notice and without refund
• We reserve the right to report illegal content to appropriate law enforcement authorities
• Determinations regarding violations are made at our sole discretion

10. Intellectual Property

10.1. All content, features, functionality, trademarks, service marks, and trade names displayed on our Services are owned by AtelierMuseAI or its licensors and are protected by international intellectual property laws.

10.2. You may not copy, reproduce, distribute, or create derivative works from any part of our Services without our prior written consent.

11. Service Availability and Modifications

11.1. Availability: We strive to maintain high service availability but do not guarantee uninterrupted, secure, or error-free operation. Services are provided on an "as is" and "as available" basis.

11.2. Scheduled Maintenance: We will endeavor to provide advance notice of scheduled maintenance when possible, but reserve the right to perform emergency maintenance without notice.

11.3. Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.

12. Account Termination

12.1. Termination by You: You may delete your account at any time by:

• Using the account deletion feature in your settings, or
• Contacting support@ateliermuseai.com

12.2. Termination by Us: We may suspend or terminate your account immediately, without prior notice, if:

• You violate any provision of these Terms
• You engage in prohibited conduct or create prohibited content
• We are required to do so by law
• We discontinue the Services

12.3. Effects of Termination:

• All licenses granted to you will immediately terminate
• All credits (subscription and package) will be forfeited
• Your videos and data will be deleted in accordance with our Privacy Policy
• You remain liable for any obligations incurred prior to termination

13. Disclaimers

13.1. No Warranties: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13.2. AI-Generated Content: We do not guarantee the accuracy, quality, appropriateness, or legality of AI-generated content. You are solely responsible for reviewing and ensuring that generated content is suitable for your intended use.

13.3. Third-Party Services: Our Services may integrate with third-party services. We are not responsible for the availability, accuracy, or content of such third-party services.

14. Limitation of Liability

14.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATELIERMUSEAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or content
• Loss of business opportunities
• Service interruptions or downtime
• Damages arising from AI-generated content
• Loss of videos due to expired storage periods
• Unauthorized access to your account

14.2. This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

15. Indemnification

You agree to indemnify, defend, and hold harmless AtelierMuseAI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or distribute using our Services

16. Changes to Terms

16.1. We reserve the right to modify these Terms at any time.

16.2. Notice of Changes: For material changes, we will provide at least 7 days' prior notice through:

• A prominent notice on our website, and/or
• Email notification to registered users

16.3. Acceptance: Your continued use of the Services after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services.

17. General Provisions

17.1. Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AtelierMuseAI regarding the Services.

17.2. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17.3. Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

17.4. Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
